Is PF Compulsory for Small Shops? What Employers and Workers Must Know

Many small shop owners in Maharashtra ask the same question: 'I have 5 workers — do I have to give PF?' And many workers wonder: 'My employer has 8 people — am I entitled to PF?' The answer depends on employee count, and the law is actually clear about this. Here's what both sides need to know.

The 20-Employee Rule for PF

PF registration under the Employees' Provident Funds Act, 1952 is mandatory only for establishments with 20 or more employees. If your business employs fewer than 20 people, PF is not legally required. This threshold includes all workers — daily wage, part-time, and contract workers all count toward the total.

The 10-Employee Rule for ESIC

ESIC has a lower threshold — it becomes mandatory when you have 10 or more employees in notified areas. So a shop with 12 workers must register for ESIC even if PF is not required. Workers earning gross salary up to ₹21,000 per month are covered. The employer contributes 3.25% and the worker contributes 0.75% of gross wages toward ESIC.

What Workers Earning Under ₹15,000 Should Know

Even if your employer has fewer than 20 workers, you and your employer can voluntarily register for PF. Once an employer is registered (whether mandatory or voluntary), all workers earning up to ₹15,000 per month in basic salary must be enrolled. Workers earning above ₹15,000 can continue PF voluntarily even after salary growth. If you're in an informal shop with no PF, ask your employer — voluntary registration is possible and both sides benefit.

What Happens If an Employer Doesn't Comply

Employers required to register for PF or ESIC who don't face significant penalties — fines, interest on arrears, and potential criminal action for willful default. If your employer deducts PF from your salary but doesn't deposit it with EPFO, file a complaint at the EPFO Grievance Portal on epfindia.gov.in — this is illegal and the EPFO takes it seriously. You can also visit your nearest EPFO regional office in Pune, Mumbai, or Nagpur.
